Important construction requirements

  1. Construction waste may not go in the HOA household-waste dumpsters; every project needs a contractor's dumpster.
  2. Any utility crossing an HOA road must go under the pavement. Damage to roads or utilities caused by the owner/contractor is paid by the owner/contractor.
  3. Preserve natural vegetation: a maximum of 40% of the property may be disturbed. Disturbed ground must be revegetated (preferably hydroseeded) with Utah Fish and Game recommended seed; the refundable fee is held until revegetation succeeds.
  4. Boundary fences are strongly discouraged so wildlife can move freely. All fences need HOA Board approval.
  5. A temporary trailer, camper or small shed during construction may be approved case by case. A portable chemical toilet (or one in the approved trailer) is required.
  6. No water wells. New homes need a shut-off valve between the water meter and the home and an indoor pressure-regulator valve. Tampering with the meter box carries a $500 fine.
  7. All construction — including additions, garages and color changes — needs Architectural Control Committee approval. New construction needs a Garden City building permit and must follow Utah State and Garden City building codes.
  8. New homes must be substantially completed within 18 months of the start date.
  9. Build to the approved plans; changes need the ARC's written approval. Unapproved deviation carries at least a $500 fine and could mean loss of the deposit or legal action, after written notice and 30 days to comply.
